Terms of use
For the Tabu: trading bots app (the version you run on your own server).
1. About TABU
TABU Trading API Bot ("TABU", "the App", "we", "us", or "our") is a software application and technical infrastructure platform designed to allow users to create, configure, operate and communicate with automated trading bots.
TABU may connect to third-party trading platforms, including Trading 212, through APIs or other technical interfaces.
TABU is an independent, unofficial third-party application and is not owned, operated, endorsed, sponsored, or officially affiliated with Trading 212 or any other third-party trading platform unless explicitly stated otherwise.
The name of a third-party trading platform may be used solely to describe compatibility or integration with that platform.
You must be at least 18 years old to use TABU. By creating an account you confirm that you are 18 or older.
These Terms include the following documents, which you can read at any time in the App (Settings, About):
- Privacy Policy;
- Risk and Trading Disclaimer;
- Account and Acceptable Use Policy;
- Third-Party Services;
- Open Source and Licences.
2. What TABU Does
TABU provides software and technical infrastructure that may allow you to:
- create and configure automated trading strategies;
- use trading bots or bot frameworks;
- create your own trading bots;
- send trading instructions or signals from the App to a bot running on TABU infrastructure;
- connect a bot to a supported third-party trading platform;
- monitor information returned by a connected trading platform;
- automate the submission of orders through an API connection; and
- use other tools and features that may be introduced in future versions of TABU.
The exact features available may change over time.
TABU primarily provides the software, server infrastructure and communication framework required for these functions.
3. TABU Is Not a Broker or Custodian
TABU does not:
- hold your money;
- hold your shares, ETFs, securities, cryptocurrencies or other assets;
- operate a customer trading account on your behalf;
- receive deposits from you for investment purposes;
- provide custody of your investments;
- execute trades as a discretionary investment manager;
- guarantee investment returns;
- guarantee that a trading strategy will make a profit;
- select investments for you;
- provide personalised investment advice; or
- guarantee that any trading strategy is suitable for you.
Your money and investments remain with the relevant third-party trading platform or financial institution.
TABU does not have ownership of your funds or investments merely because you connect your account or API credentials to the App.
4. No Financial or Investment Advice
TABU is a software and technology platform.
Nothing provided through TABU should be interpreted as:
- financial advice;
- investment advice;
- personal investment recommendations;
- a recommendation to buy or sell a particular security;
- portfolio management;
- a guarantee of investment performance; or
- a recommendation that a particular trading strategy is suitable for you.
You are solely responsible for deciding whether to use a trading strategy, bot, security, instrument, market or trading platform.
You should obtain independent financial advice if you require advice about your personal circumstances or investments.
5. Automated Trading
Automated trading involves significant risks.
A bot may automatically generate or submit orders without requiring manual confirmation for every transaction.
Depending on the strategy and configuration, a bot may:
- buy or sell securities;
- generate repeated orders;
- trade at prices different from those expected;
- continue operating while you are not actively monitoring it;
- respond to market movements;
- make losses;
- experience technical errors;
- submit an unintended order;
- fail to submit an intended order; or
- behave differently from what you expected because of market conditions, software errors, API limitations or other circumstances.
You are responsible for understanding and testing any bot before allowing it to trade with real money.
6. User Responsibility for Trading Decisions
You are solely responsible for:
- your trading decisions;
- the strategies you choose;
- the assets and instruments you trade;
- the parameters you configure;
- the amount of money exposed to trading;
- your use of leverage, if available;
- the operation of your bots;
- reviewing orders and transactions;
- monitoring your trading account;
- ensuring your strategy is appropriate for your circumstances;
- complying with applicable laws and regulations; and
- complying with the terms and conditions of the relevant third-party trading platform.
TABU does not determine whether a particular trade is appropriate for you.
7. User-Created Bots
TABU may allow users to create their own bots, strategies, scripts, configurations or other automated trading logic.
Where you create your own bot or strategy, you are solely responsible for it.
TABU does not guarantee that a user-created bot will:
- operate correctly;
- operate continuously;
- generate the intended signals;
- generate profitable trades;
- avoid losses;
- comply with your intended strategy;
- correctly interpret market data; or
- correctly communicate with a third-party trading platform.
You should thoroughly test user-created bots before using them with real funds.
8. TABU Bot Frameworks and Templates
TABU may provide pre-built bot frameworks, templates, examples, strategies, configurations or other software components.
These are provided as software tools and are not guarantees of investment performance.
Any historical results, examples, simulations, demonstrations or hypothetical performance figures should not be interpreted as guarantees of future performance.
Past performance does not guarantee future results.
9. Third-Party Trading Platforms
TABU may integrate with third-party services such as Trading 212.
Your use of any third-party trading platform is subject to that platform's own terms, conditions, policies and requirements.
TABU does not control:
- the availability of third-party platforms;
- their APIs;
- their servers;
- their trading systems;
- their execution systems;
- their fees;
- their trading rules;
- their account restrictions;
- their outages;
- their API limits;
- their order execution; or
- changes they make to their services.
A third-party platform may change or discontinue an API or integration at any time.
Such changes may cause TABU functionality to stop working or operate differently.
10. Order Execution
TABU does not guarantee the execution of any order.
Orders submitted through a bot may be:
- rejected;
- delayed;
- partially filled;
- filled at a different price;
- cancelled;
- duplicated;
- not submitted;
- submitted after the market has moved; or
- otherwise affected by circumstances outside TABU's control.
Market prices can change rapidly.
The price displayed in TABU or another application may differ from the eventual execution price.
The relevant third-party trading platform remains responsible for the actual execution of orders placed through its systems.
11. API Credentials and Account Security
You are responsible for maintaining the security of your trading account and API credentials.
You must not provide your credentials to unauthorised persons.
Where TABU requires API credentials or tokens to connect to a third-party platform, you authorise TABU to use those credentials solely for the technical functions you have enabled.
You should use the minimum permissions necessary for the intended functionality where the third-party platform provides permission controls.
You should immediately revoke or change credentials if you believe they have been compromised.
TABU will not be responsible for losses caused by credentials being disclosed, stolen, improperly configured or otherwise compromised, except where liability cannot lawfully be excluded.
12. No Guarantee of Availability
TABU is provided on an "as available" and "as is" basis to the maximum extent permitted by law.
We do not guarantee that:
- the App will always be available;
- servers will operate continuously;
- bots will operate continuously;
- API connections will always function;
- signals will always be delivered;
- orders will always be submitted;
- data will always be accurate or current;
- third-party integrations will remain available;
- software will be completely free from errors; or
- the service will meet every particular requirement.
Maintenance, updates, technical problems, outages, security incidents or third-party service changes may temporarily interrupt the service.
13. Trading and Financial Risk
Trading financial instruments involves the risk of losing money.
You should only trade money that you can afford to lose.
Automated trading can increase the speed and frequency with which transactions occur and may therefore increase potential losses.
You acknowledge that you may lose some or all of the money allocated to a trading strategy.
TABU does not guarantee that any strategy, bot or configuration will be profitable.
14. No Responsibility for Investment Losses
To the maximum extent permitted by applicable law, TABU and its owner, developers, operators and service providers are not responsible for investment losses resulting from:
- market movements;
- trading decisions;
- bot configuration;
- user-created strategies;
- incorrect parameters;
- API failures;
- third-party platform failures;
- delayed data;
- incorrect or unavailable market data;
- order execution prices;
- rejected orders;
- duplicated orders;
- missed orders;
- network failures;
- server failures;
- software errors;
- third-party service changes;
- account restrictions;
- trading platform outages; or
- any other event outside TABU's reasonable control.
Nothing in these Terms excludes liability that cannot legally be excluded or limited.
15. No Guarantee Against Duplicate or Unintended Orders
Because automated trading depends on software, APIs, networks and third-party systems, there is a risk that an order may be submitted more than once or that an order may be different from what you intended.
You are responsible for implementing appropriate safeguards, including, where available:
- position limits;
- order limits;
- maximum trade amounts;
- stop conditions;
- maximum daily loss limits;
- duplicate-order protection; and
- monitoring mechanisms.
TABU may provide some of these safeguards, but their availability does not constitute a guarantee that unintended trades cannot occur.
16. User Monitoring
You should regularly monitor your trading account and any active bots.
Do not assume that a bot will automatically stop because a particular market condition, price, loss or other event occurs unless that functionality has been specifically implemented and tested.
TABU recommends that users understand how their bot operates before allowing it to trade with real funds.
17. Software Updates
TABU may update, modify, suspend or discontinue features at any time.
Updates may alter:
- bot behaviour;
- API communication;
- available settings;
- supported trading platforms;
- server functionality;
- security features; or
- other aspects of the App.
Where reasonably practical, we may provide information about significant changes.
18. Prohibited Use
You must not use TABU:
- for unlawful purposes;
- to violate the terms of a third-party trading platform;
- to interfere with or disrupt third-party systems;
- to gain unauthorised access to accounts or systems;
- to distribute malware;
- to conduct fraudulent activity;
- to manipulate or abuse APIs;
- to circumvent technical restrictions;
- to infringe another person's rights; or
- in any manner prohibited by applicable law.
You are responsible for ensuring that your use of TABU is lawful in your jurisdiction.
19. Intellectual Property
TABU and its software, interface, branding, documentation, code and other materials are owned by or licensed to TABU and are protected by applicable intellectual property laws.
Except where expressly permitted, you must not:
- copy the App;
- reproduce substantial parts of the software;
- resell the software;
- reverse engineer the service where prohibited by law;
- redistribute proprietary components;
- remove copyright or proprietary notices; or
- use TABU's branding without permission.
Your own trading strategies, configurations and bot code remain yours, subject to any separate licence terms that apply to third-party or TABU-provided components.
20. User Content and Code
If TABU allows you to upload or create code, strategies, configurations or other content, you remain responsible for that content.
You must ensure that you have the necessary rights to use and upload it.
You grant TABU only the permissions reasonably necessary to host, process, execute, transmit or otherwise provide the functionality you have requested.
21. Fees
TABU may be offered as a free service, paid service, subscription service or a combination of these.
Any applicable fees will be presented before you are charged.
Third-party trading platforms may separately charge their own fees, commissions, spreads, currency-conversion charges or other costs.
TABU is not responsible for fees charged by third parties.
22. Termination
You may stop using TABU at any time.
We may suspend or terminate access where reasonably necessary, including where:
- you breach these Terms;
- your use creates a security risk;
- you use the service unlawfully;
- required by law;
- a third-party integration becomes unavailable; or
- continued operation of your account is not reasonably possible.
Termination of TABU does not automatically close your third-party trading account.
You remain responsible for managing or disabling any active trading bots and API connections.
23. Data and Privacy
Your use of TABU may involve the processing of account information, API information, trading information, bot configurations, logs and technical information.
Our handling of personal data is described in our separate Privacy Policy.
You should read the Privacy Policy before using TABU.
24. Limitation of Liability
To the maximum extent permitted by applicable law, TABU, its owner, developers, operators and service providers shall not be liable for indirect, incidental, special or consequential losses, including loss of profits, loss of investment value, loss of opportunity, loss of data or business interruption arising from your use of the service.
Where liability cannot legally be excluded, it will be limited to the maximum extent permitted by applicable law.
Nothing in these Terms excludes or limits liability for matters that cannot legally be excluded or limited, including liability for fraud or fraudulent misrepresentation or other statutory rights that cannot be excluded.
25. No Waiver of Consumer Rights
Nothing in these Terms is intended to remove or restrict any legal rights you may have that cannot lawfully be excluded or restricted.
If you are a consumer, applicable consumer protection laws may provide rights in addition to those described in these Terms.
26. Changes to These Terms
We may update these Terms from time to time.
When we make material changes, we may provide reasonable notice where appropriate.
Your continued use of TABU after the updated Terms take effect constitutes acceptance of the updated Terms to the extent permitted by law.
27. Governing Law
These Terms shall be governed by the laws of England and Wales, unless applicable mandatory consumer protection laws require otherwise.
The courts of England and Wales shall have jurisdiction, subject to any mandatory rights you may have under applicable consumer protection legislation.
